(A) 323 2 PERLEMBAGAAN PERSEKUTUAN PROKLAMASI DARURAT (SARAWAK) OLEH KEBAWAH DULI YANG MAHA MULIA SERI PADUKA BAGINDA YANG DI-PERTUAN AGONG, DENGAN KURNIA ALLAH, KETUA UTAMA NEGARA BAGI NEGERI-NEGERI DAN WILAYAH-WILAYAH MALAYSIA BAHAWASANYA BETA berpuas hati bahawa suatu darurat besar sedang berlaku yang menyebabkan keselamatan, kehidupan ekonomi dan ketenteraman awam di dalam Persekutuan adalah diancam berikutan wabak penyakit berjangkit, iaitu Penyakit Koronavirus 2019 (COVID-19): DAN BAHAWASANYA menurut Fasal (3) Perkara 21 Perlembagaan Negeri Sarawak, Dewan Undangan Negeri bagi Negeri Sarawak (kemudian daripada ini disebut sebagai “Dewan Undangan Negeri”) telah sepatutnya terbubar pada 7 Jun 2021, tetapi Fasal (3) Perkara 21 tidak mempunyai kesan menurut perenggan 15(1)(a) Ordinan Darurat (Kuasa-Kuasa Perlu) 2021 [P.U. (A) 12/2021] yang menggantung pembubaran Dewan Undangan Negeri: DAN BAHAWASANYA perenggan 15(1)(a) Ordinan Darurat (Kuasa-Kuasa Perlu) 2021 akan terhenti berkuat kuasa pada 2 Ogos 2021 mengikut Proklamasi Darurat [P.U. (A) 7/2021] yang dikeluarkan pada 11 Januari 2021 yang pilihan raya umum ke Dewan Undangan Negeri dikehendaki untuk diadakan dalam enam puluh hari dari 2 Ogos 2021 mengikut Fasal

(4) Perkara 21 Perlembagaan Negeri Sarawak: DAN BAHAWASANYA Fasal (1) Perkara 150 Perlembagaan Persekutuan memperuntukkan bahawa dalam keadaan yang tersebut BETA boleh mengeluarkan suatu Proklamasi Darurat untuk menggantung pilihan raya umum ke Dewan Undangan Negeri untuk menghalang daripada terus merebaknya wabak COVID-19 jika pilihan raya umum diadakan: P.U. (A) 323 3 MAKA, OLEH YANG DEMIKIAN, BETA, AL-SULTAN ABDULLAH RI’AYATUDDIN AL-MUSTAFA BILLAH SHAH IBNI ALMARHUM SULTAN HAJI AHMAD SHAH AL-MUSTA’IN BILLAH, dengan Kurnia Allah, Yang di-Pertuan Agong bagi Negeri-Negeri dan wilayah-wilayah Malaysia, pada menjalankan kuasa yang diberikan kepada BETA sebagaimana yang tersebut di atas MENGISYTIHARKAN bahawa suatu darurat besar sedang berlaku dan bahawa Proklamasi ini hendaklah meliputi seluruh Negeri Sarawak mulai 2 Ogos 2021 hingga 2 Februari 2022: DIKELUARKAN di Istana Abdulaziz BETA di Indera Mahkota, Kuantan, Pahang Darul Makmur, pada dua puluh sembilan hari bulan Julai, dua ribu dua puluh satu. (3) Perkara 150 Perlembagaan Persekutuan] P.U. (A) 323 4 THE FEDERAL CONSTITUTION PROCLAMATION OF EMERGENCY BY HIS MAJESTY THE YANG DI-PERTUAN AGONG, BY THE GRACE OF ALLAH, SUPREME HEAD OF THE STATES AND TERRITORIES OF MALAYSIA WHEREAS WE are satisfied that a grave emergency exists whereby the security, economic life and public order in the Federation are threatened arising from the epidemic of an infectious disease, namely Coronavirus Disease 2019 (COVID-19): AND WHEREAS pursuant to Clause (3) of Article 21 of the Constitution of the State of Sarawak, the Dewan Undangan Negeri of the State of Sarawak (hereinafter referred to as the “Dewan Undangan Negeri”) should have stood dissolved on 7 June 2021, but the said Clause (3) of Article 21 had no effect pursuant to paragraph 15(1)(a) of the Emergency (Essential Powers) Ordinance 2021 [P.U. (A) 12/2021] which suspends the dissolution of the Dewan Undangan Negeri: AND WHEREAS paragraph 15(1)(a) of the Emergency (Essential Powers) Ordinance 2021 shall cease to have effect on 2 August 2021 in accordance with the Proclamation of Emergency [P.U. (A) 7/2021] issued on 11 January 2021 whereby the general election to the Dewan Undangan Negeri is required to be held within sixty days from 2 August 2021 in accordance with Clause (4) of Article 21 of the Constitution of the State of Sarawak: AND WHEREAS Clause (1) of Article 150 of the Federal Constitution provides that in the said circumstances WE may issue a Proclamation of Emergency to suspend the general election to the Dewan Undangan Negeri in order to prevent any further increase in the spread of the epidemic of COVID-19 if the general election is held: NOW, THEREFORE, WE, AL-SULTAN ABDULLAH RI’AYATUDDIN AL-MUSTAFA BILLAH SHAH IBNI ALMARHUM SULTAN HAJI AHMAD SHAH AL-MUSTA’IN BILLAH, by the Grace of Allah, Yang di-Pertuan Agong of the States and territories of Malaysia, in exercise of the powers conferred on US as aforesaid PROCLAIM that a grave emergency P.U. (A) 323 5 exists and that this Proclamation shall extend throughout the State of Sarawak from 2 August 2021 to 2 February 2022: ISSUED at OUR Istana Abdulaziz in Indera Mahkota, Kuantan, Pahang Darul Makmur, this twenty ninth day of July, two thousand twenty one.
