ORDINAN DARURAT (KUASA-KUASA PERLU) (NO. 3) 2020

Bagi tempoh darurat berkuat kuasa, kehendak untuk mengisi kekosongan di kalangan ahli Dewan Undangan dalam tempoh enam puluh hari dari tarikh dipastikan adanya kekosongan di bawah Fasal (5) Perkara 21 Perlembagaan Negeri Sabah tidak mempunyai kesan bagi maksud Bahagian Pilihan Raya Negeri N.66 Bugaya, Sabah.

Tarikh yang telah ditetapkan bagi maksud menjalankan pilihan raya kecil bagi Bahagian Pilihan Raya Negeri N.66 Bugaya, Sabah adalah dibatalkan dan apa-apa prosiding yang telah bermula bagi maksud penjalanan pilihan raya itu tidak diteruskan.

Bagi maksud mengadakan pilihan raya kecil bagi mengisi kekosongan bagi Bahagian Pilihan Raya Negeri N.66 Bugaya, Sabah, Suruhanjaya Pilihan Raya hendaklah menetapkan pilihan raya kecil itu dalam tempoh enam puluh hari dari tarikh Proklamasi Darurat (No. 3) dibatalkan atau diungkaikan, tertakluk kepada proviso kepada Fasal (5) Perkara 21 Perlembagaan Negeri Sabah tentang kekosongan luar jangka.

DIMASYHURKAN di Istana Negara BETA di Kuala Lumpur, Ibu Kota Persekutuan pada dua belas hari bulan Disember, dua ribu dua puluh.

EMERGENCY (ESSENTIAL POWERS) (NO. 3) ORDINANCE 2020

Yang di-Pertuan

Agong pursuant to Clause (2B) of Article 150 of the Federal Constitution.

WHEREAS by reason of the existence of a grave emergency threatening the security, economic life and public order in a part of the Federation namely the State Constituency of N.66 Bugaya, Sabah arising from the epidemic of an infectious disease, namely

Coronavirus

Disease 2019

(COVID-19), a Proclamation of Emergency has been issued by the Yang di-Pertuan Agong under Article 150 of the Federal Constitution on this twelfth day of December, two thousand twenty:

AND WHEREAS the Yang di-Pertuan Agong is satisfied that immediate action is required to guarantee and preserve the security, economic life and public order:

IT IS HEREBY PROMULGATED AN ORDINANCE by the Yang di-Pertuan Agong pursuant to Clause (2B) of Article 150 of the Federal Constitution as follows:

Short title 1.

This ordinance may be cited as the Emergency (Essential Powers) (No. 3)

Ordinance 2020.

Election of Legislative Assembly 2.

For so long as the emergency is in force, the requirement to fill the vacancy amongst members of the Legislative Assembly within sixty days from the date on which it is established that there is a vacancy under Clause (5) of Article 21

of the Constitution of the State of Sabah shall not have effect for the purposes of the State Constituency of N.66 Bugaya, Sabah.

The dates that have been specified for the purpose of conducting the by-election for the State Constituency of N.66 Bugaya, Sabah shall be revoked and any proceedings commenced for the purpose of conducting the election shall not be continued.

For the purpose of holding the by-election to fill the vacancy for the the

State Constituency of N.66 Bugaya, Sabah, the Election Commission shall hold the by-election within sixty days from the date of the Proclamation of Emergency (No. 3)

is revoked or annulled, subject to the proviso to Clause (5) of Article 21 of the Constitution of the State of Sabah on casual vacancy.

PROMULGATED at OUR Istana Negara in Kuala Lumpur, the Federal Capital, this twelfth day of December, two thousand twenty.
