Bagi tempoh darurat berkuat kuasa, kehendak untuk mengisi kekosongan luar jangka di kalangan ahli Dewan Rakyat dalam tempoh enam puluh hari dari tarikh dipastikan oleh Suruhanjaya Pilihan Raya bahawa ada kekosongan luar jangka di bawah Perkara 54 Perlembagaan Persekutuan tidak mempunyai kesan bagi maksud Bahagian Pilihan Raya Parlimen P.054 Gerik, Perak.

Tarikh yang telah ditetapkan bagi maksud menjalankan pilihan raya kecil bagi Bahagian Pilihan Raya Parlimen P.054 Gerik, Perak adalah dibatalkan dan apa-apa prosiding yang telah bermula bagi maksud penjalanan pilihan raya itu tidak diteruskan.

Bagi maksud mengadakan pilihan raya kecil bagi mengisi kekosongan luar jangka bagi Bahagian Pilihan Raya Parlimen P.054 Gerik, Perak, Suruhanjaya Pilihan

Raya hendaklah menetapkan pilihan raya kecil itu dalam tempoh enam puluh hari dari tarikh Proklamasi Darurat (No. 2) dibatalkan atau diungkaikan, tertakluk kepada proviso kepada Fasal (1) Perkara 54 Perlembagaan Persekutuan tentang kekosongan luar jangka.

EMERGENCY (ESSENTIAL POWERS) (NO. 2) ORDINANCE 2020

An Ordinance promulgated by the Yang di-Pertuan Agong pursuant to Clause (2B)

of Article 150 of the Federal Constitution.

[12 December 2020]

WHEREAS by reason of the existence of a grave emergency threatening the security, economic life and public order in a part of the

Federation namely the Parliamentary Constituency of P. 054 Gerik, Perak arising from the epidemic of an infectious disease, namely Coronavirus Disease 2019 (COVID-19), a Proclamation of Emergency has been issued by the Yang di-Pertuan Agong under Article 150 of the Federal Constitution on this twelfth day of December, two thousand twenty:

AND WHEREAS the Yang di-Pertuan Agong is satisfied that immediate action is required to guarantee and preserve the security, economic life and public order:

IT IS HEREBY PROMULGATED AN ORDINANCE by the Yang di-Pertuan Agong pursuant to Clause (2B) of Article 150 of the Federal Constitution as follows:

Short title 1.

This ordinance may be cited as the Emergency (Essential Powers) (No. 2)

Ordinance 2020.

Election of Parliament 2.

For so long as the emergency is in force, the requirement to fill the casual vacancy amongst members of the House of Representatives within sixty days from the date on which it is established by the Election Commission that there is a casual vacancy under Article 54 of the Federal Constitution shall not have effect for the purposes of the

Parliamentary Constituency of P.054 Gerik, Perak.

The dates that have been specified for the purpose of conducting the by-election for the Parliamentary Constituency of P.054 Gerik, Perak shall be revoked and any proceedings commenced for the purpose of conducting the election shall not be continued.

For the purpose of holding the by-election to fill the casual vacancy for the

Parliamentary Constituency of P.054 Gerik, Perak, the Election Commission shall hold the by-election within sixty days from the date of the Proclamation of Emergency

(No. 2) is revoked or annulled, subject to the proviso to Clause (1) of Article 54 of the

Federal Constitution on casual vacancy.
