PADA menjalankan kuasa yang diberikan oleh seksyen 77 dan 85 Akta Sistem Insurans Pekerjaan 2017 [Akta 800], Menteri, dengan kelulusan Pendakwa Raya, membuat peraturan-peraturan yang berikut: Nama dan permulaan kuat kuasa 1.

(1) Peraturan-peraturan ini bolehlah dinamakan Peraturan-Peraturan Sistem Insurans Pekerjaan (Pengkompaunan Kesalahan) 2018.

(2) Peraturan-Peraturan ini mula berkuat kuasa pada 20 November 2018. Kesalahan yang boleh dikompaun 2.

(1) Kesalahan yang dinyatakan dalam Jadual Pertama ditetapkan sebagai kesalahan yang boleh dikompaun.

(2) Kesalahan yang disebut dalam subperaturan (1) boleh dikompaun dengan keizinan bertulis Pendakwa Raya dalam Borang SIPK 1 Jadual Kedua. Tawaran dan penyetujuterimaan kompaun 3.

(1) Suatu tawaran untuk mengkompaun kesalahan yang disebut dalam subperaturan 2(1) hendaklah dibuat dalam Borang SIPK 2 Jadual Kedua.

(2) Seseorang yang menyetuju terima tawaran untuk mengkompaun kesalahan yang disebut dalam subperaturan 2(1) hendaklah menyetuju terima tawaran itu dalam Borang SIPK 3 Jadual Kedua dan memulangkan Borang itu kepada Pertubuhan. Cara mengkompaun 4.

(1) Apabila menerima apa-apa maklumat atau aduan bahawa suatu kesalahan yang disebut dalam subperaturan 2(1) telah dilakukan, Ketua Pengarah atau mana-mana pegawai Pertubuhan yang diberi kuasa secara bertulis oleh Ketua Pengarah boleh P.U. (A) 294 3 mengeluarkan suatu tawaran untuk mengkompaun kesalahan itu dalam Borang SIPK 2

Jadual Kedua kepada orang yang disyaki dengan munasabah telah melakukan kesalahan itu. (2) Tawaran untuk mengkompaun suatu kesalahan di bawah subperaturan (1) adalah sah bagi tempoh empat belas hari atau apa-apa tempoh lanjutan sebagaimana yang diberikan oleh Ketua Pengarah, dan jika pembayaran penuh bagi jumlah yang ditawarkan itu dibuat dalam tempoh empat belas hari itu atau apa-apa tempoh lanjutan sebagaimana yang diberikan oleh Ketua Pengarah, tiada prosiding selanjutnya boleh diambil terhadap orang yang disebut dalam subperaturan (1). (3) Jika tiada pembayaran bagi kompaun yang ditawarkan itu dibuat dalam tempoh yang dinyatakan dalam subperaturan (2), pendakwaan boleh dimulakan terhadap orang yang disebut dalam subperaturan (1) tanpa notis selanjutnya. Pembayaran kompaun 5. (1) Jika suatu tawaran untuk mengkompaun kesalahan di bawah subperaturan 4(1) disetuju terima oleh orang yang kepadanya tawaran itu dibuat, dia boleh membayar kompaun itu— (a) melalui kiriman wang, wang pos, perintah juruwang, arahan bank atau draf bank yang kena dibayar kepada Ketua Pengarah dan dipalang dengan perkataan “Akaun Penerima Sahaja”; atau (b) melalui pemindahan wang secara elektronik. (2) Jika pembayaran dibuat mengikut perenggan (1)(a), kiriman wang, wang pos, perintah juruwang, arahan bank atau draf bank itu hendaklah diserahkan sendiri kepada Ketua Pengarah atau dihantar melalui pos berdaftar ke alamat yang dinyatakan dalam Borang SIPK 2 Jadual Kedua. P.U. (A) 294 4 (3) Apabila pembayaran yang dibuat mengikut subperaturan (1) diterima, Ketua Pengarah hendaklah mengeluarkan suatu resit rasmi bagi pembayaran itu kepada orang yang kepadanya tawaran untuk mengkompaun kesalahan itu dibuat. (4) Suatu resit rasmi yang dikeluarkan di bawah subperaturan (3) hendaklah termasuk apa-apa resit elektronik jika pembayaran dibuat melalui pemindahan wang secara elektronik sebagaimana yang dinyatakan dalam perenggan (1)(b). Borang 6. Pertubuhan hendaklah menjadikan tersedia semua borang yang dinyatakan dalam

Jadual Kedua di pejabat Pertubuhan dan menyebabkan semua borang itu disiarkan dalam laman sesawang rasmi Pertubuhan.

JADUAL PERTAMA [Subperaturan 2(1)] KESALAHAN YANG BOLEH DIKOMPAUN 1. Kesalahan yang dilakukan di bawah peruntukan Akta Sistem Insurans Pekerjaan 2017 seperti yang berikut: (a) subseksyen 14(2); (b) subseksyen 16(5); (c) subseksyen 24(2); (d) subseksyen 70(3); (e) seksyen 71; dan (f) subseksyen 78(3). P.U. (A) 294 5 2. Kesalahan yang dilakukan di bawah peruntukan Peraturan-Peraturan Sistem Insurans Pekerjaan (Pendaftaran dan Caruman) 2017 [P.U. (A) 452/2017] seperti yang berikut: (a) subperaturan 2(3); dan (b) subperaturan 4(4).

(A) 294 6 EMPLOYMENT INSURANCE SYSTEM ACT 2017 EMPLOYMENT INSURANCE SYSTEM (COMPOUNDING OF OFFENCES) REGULATIONS 2018 IN exercise of the powers conferred by sections 77 and 85 of the Employment Insurance System Act 2017 [Act 800], the Minister, with the approval of the Public Prosecutor, makes the following regulations: Citation and commencement 1. (1) These regulations may be cited as the Employment Insurance System (Compounding of Offences) Regulations 2018. (2) These Regulations come into operation on 20 November 2018. Offences which may be compounded 2. (1) The offences specified in the First Schedule are prescribed as offences which may be compounded. (2) The offences referred to in subregulation (1) may be compounded with the consent in writing of the Public Prosecutor in Form SIPK 1 of the Second Schedule. Offer and acceptance of compound 3. (1) An offer to compound an offence referred to in subregulation 2(1) shall be made in Form SIPK 2 of the Second Schedule. (2) A person who accepts an offer to compound an offence referred to in subregulation 2(1) shall accept the offer in Form SIPK 3 of the Second Schedule and return the Form to the Organization. Method of compounding 4. (1) Upon receipt of any information or complaint that an offence referred to in subregulation 2(1) has been committed, the Director General or any officer of the Organization authorized in writing by the Director General may issue an offer to P.U. (A) 294 7 compound the offence in Form SIPK 2 of the Second Schedule to the person reasonably suspected of having committed the offence. (2) An offer to compound an offence under subregulation (1) shall be valid for a period of fourteen days or such extended time as the Director General may grant, and if full payment of the sum offered is made within the period of fourteen days or such extended time as the Director General may grant, no further proceedings shall be taken against the person referred to in subregulation (1). (3) If no payment of the compound offered is made within the period stated in subregulation (2), prosecution may be instituted against the person referred to in subregulation (1) without further notice. Payment of compound 5. (1) If an offer to compound an offence under subregulation 4(1) is accepted by the person to whom the offer is made, he may pay the compound— (a) by money order, postal order, cashier’s order, banker’s order or bank draft payable to the Director General and crossed with the words “Account Payee Only”; or (b) through an electronic fund transfer. (2) If the payment is made in accordance with paragraph (1)(a), the money order, postal order, cashier’s order, banker’s order or bank draft shall be delivered personally to the Director General or sent by registered post to the address specified in Form SIPK 2 of the Second Schedule. (3) Upon receipt of the payment made in accordance with subregulation (1), the Director General shall issue an official receipt for such payment to the person to whom the offer to compound an offence is made. P.U. (A) 294 8 (4) An official receipt issued under subregulation (3) shall include any electronic receipt if the payment is made through an electronic fund transfer as specified in paragraph (1)(b). Forms 6. The Organization shall make available all forms specified in the Second Schedule at the office of the Organization and cause all such forms to be published in its official website. FIRST SCHEDULE [Subregulation 2(1)] OFFENCES WHICH MAY BE COMPOUNDED 1. The offences committed under the following provisions of the Employment Insurance System Act 2017: (a) subsection 14(2); (b) subsection 16(5); (c) subsection 24(2); (d) subsection 70(3); (e) section 71; and (f) subsection 78(3). 2. The offences committed under the following provisions of the Employment Insurance System (Registration and Contribution) Regulations 2017 [P.U.
