Preamble
An Act to amend the Poisons Act 1952. [ ] ENACTED by the Parliament of Malaysia as follows: Short title and commencement

1. (1) This Act may be cited as the Poisons (Amendment) Act 2025.

(2) This Act comes into operation on a date to be appointed by the Minister by notification in the Gazette. Amendment of section 2

2. The Poisons Act 1952 [Act 366], which is referred to as the “principal Act” in this Act, is amended in subsection 2(1)—

(a) in the definition of “authorized officer”—

(i) by substituting for paragraph (b) the following paragraph: “(b) a police officer as defined under the Police Act 1967 [Act 344];”; Laws of Malaysia Poisons (Amendment) Act 2025 4 Laws of Malaysia
subparagraph_7

(ii) in paragraph (c), by inserting the word “or” at the end of the paragraph; and
subparagraph_8
Subparagraph
(iii) by inserting after paragraph (c) the following paragraph: “(d) a person appointed by the Minister under section 31a;”; and

(b) by substituting for the definition of “premises” the following definition: ‘ “premises” includes—

(a) any land, building or part of any building;
paragraph_11
Paragraph
(b) any place whether open or enclosed;
paragraph_12

(c) any conveyance;
paragraph_13
Paragraph
(d) any installation on land, offshore installation or other installation whether on the bed of or floating on any water; and

(e) any structure whether movable or immovable;’. Renumbering of section 31a

3. The principal Act is amended by renumbering the existing section 31a as section 31aa. New section 31a

4. The principal Act is amended by inserting before section 31aa as renumbered the following section: “ Appointment of authorized officer 31a. The Minister may appoint in writing any person to be an authorized officer subject to such terms and conditions as the Minister may impose.”. Poisons (Amendment) 5 Amendment of section 31b

5. Section 31b of the principal Act is amended by deleting subsection (1).
